Pr\u00e1ce, kter\u00e1 je vykon\u00e1v\u00e1na ve vztahu nad\u0159\u00edzenosti zam\u011bstnavatele a pod\u0159\u00edzenosti zam\u011bstnance. Jm\u00e9nem zam\u011bstnavatele a podle jeho pokyn\u016f. <a href=\"https:\/\/orangeacademy.cz\/clanky\/zamestnanecke-benefity\/\" target=\"_blank\" rel=\"noopener\">Zam\u011bstnanec<\/a> ji vykon\u00e1v\u00e1 osobn\u011b a n\u00e1le\u017e\u00ed mu mzda, plat nebo odm\u011bna za pr\u00e1ci.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Z\u00e1kladn\u00edmi pracovn\u011bpr\u00e1vn\u00edmi vztahy jsou:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">hlavn\u00ed pracovn\u00ed pom\u011br,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>dohoda o proveden\u00ed pr\u00e1ce,<\/strong><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">dohoda o pracovn\u00ed \u010dinnosti.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Dohoda o proveden\u00ed pr\u00e1ce p\u0159edstavuje specifick\u00fd smluvn\u00ed vztah mezi zam\u011bstnancem a zam\u011bstnavatelem. Tato dohoda se <strong>uzav\u00edr\u00e1 p\u00edsemn\u011b a neobsahuje zku\u0161ebn\u00ed dobu<\/strong>. Mus\u00ed zahrnovat n\u00e1sleduj\u00edc\u00ed n\u00e1le\u017eitosti:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">dobu trv\u00e1n\u00ed dohody,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">specifikaci \u00fakolu nebo \u010dinnosti,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">v\u00fd\u0161i sjednan\u00e9 odm\u011bny,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">rozsah pr\u00e1ce, kter\u00fd nesm\u00ed p\u0159es\u00e1hnout 300 hodin ro\u010dn\u011b.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Pracovn\u00ed smlouva mus\u00ed b\u00fdt podepsan\u00e1 nejpozd\u011bji v den n\u00e1stupu do pr\u00e1ce a mus\u00ed m\u00edt obsahovat z\u00e1konn\u00e9 n\u00e1le\u017eitosti:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">druh pr\u00e1ce,\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> m\u00edsto v\u00fdkonu pr\u00e1ce,\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> den n\u00e1stupu do pr\u00e1ce.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">Dohoda o proveden\u00ed pr\u00e1ce &#8211; dan\u011b<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Zam\u011bstnanec m\u016f\u017ee uzav\u0159\u00edt DPP s<strong> libovoln\u00fdm po\u010dtem zam\u011bstnavatel\u016f.<\/strong> P\u016fvodn\u011b m\u011blo od roku 2025 doj\u00edt ke zp\u0159\u00edsn\u011bn\u00ed podm\u00ednek a omezen\u00ed po\u010dtu p\u0159iv\u00fdd\u011blk\u016f na DPP, ale tato zm\u011bna byla nakonec zru\u0161ena. Jedinou zm\u011bnou, kter\u00e1 vstoup\u00ed v platnost od roku 2025, je zv\u00fd\u0161en\u00ed limitu pro neplacen\u00ed zdravotn\u00edho a soci\u00e1ln\u00edho poji\u0161t\u011bn\u00ed.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dohoda o proveden\u00ed pr\u00e1ce nad 10.000 K\u010d se tedy ru\u0161\u00ed. Tento limit bude nov\u011b \u010dinit 25 % pr\u016fm\u011brn\u00e9 mzdy, co\u017e pro rok 2025 znamen\u00e1 \u010d\u00e1stku 11.499 K\u010d u jednoho zam\u011bstnavatele. Pokud m\u00e1 zam\u011bstnanec uzav\u0159eno v\u00edce dohod u jednoho zam\u011bstnavatele, p\u0159\u00edjmy se s\u010d\u00edtaj\u00ed. V p\u0159\u00edpad\u011b, \u017ee p\u0159\u00edjem z DPP p\u0159es\u00e1hne \u010d\u00e1stku 11.499 K\u010d, tak se zam\u011bstnanec \u00fa\u010dastn\u00ed <strong>plateb na nemocensk\u00e9 poji\u0161t\u011bn\u00ed a je z toho odv\u00e1d\u011bno krom\u011b dan\u011b z p\u0159\u00edjmu i soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed.<\/strong><\/span><\/p>\n<div id=\"attachment_10113\" style=\"width: 940px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-10113\" class=\"wp-image-10113 size-large\" src=\"https:\/\/orangeacademy.cz\/clanky\/wp-content\/uploads\/2019\/09\/DPP-930x620.jpeg\" alt=\"\" width=\"930\" height=\"620\" \/><p id=\"caption-attachment-10113\" class=\"wp-caption-text\">Pr\u00e1ce pro jednoho zam\u011bstnavatele v r\u00e1mci dohody o proveden\u00ed pr\u00e1ce nesm\u00ed v kalend\u00e1\u0159n\u00edm roce p\u0159es\u00e1hnout 300 hodin.<\/p><\/div>\n<h2><span class=\"ez-toc-section\" id=\"Vyhody_a_nevyhody_prace_na_dohodu\"><\/span><span style=\"font-weight: 400;\">V\u00fdhody a nev\u00fdhody pr\u00e1ce na dohodu<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h4><b>1. Jednoduch\u00e1 administrativa<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">Jednou z nejv\u011bt\u0161\u00edch v\u00fdhod DPP je jej\u00ed jednoduch\u00e1 administrativa. Na rozd\u00edl od klasick\u00e9ho pracovn\u00edho pom\u011bru nebo pr\u00e1ce na \u017eivnostensk\u00fd list, kde je pot\u0159eba \u0159e\u0161it mnoho administrativn\u00edch \u00fakon\u016f, je uzav\u0159en\u00ed DPP mnohem jednodu\u0161\u0161\u00ed a rychlej\u0161\u00ed.<\/span><\/p>\n<h4><b>2. Ni\u017e\u0161\u00ed odvody na soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">P\u0159i v\u00fdd\u011blku do 11.499 K\u010d m\u011bs\u00ed\u010dn\u011b nen\u00ed nutn\u00e9 <a href=\"https:\/\/orangeacademy.cz\/clanky\/kdo-nemusi-platit-socialni-pojisteni\/\" target=\"_blank\" rel=\"noopener\">odv\u00e1d\u011bt soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed.<\/a> To znamen\u00e1, \u017ee zam\u011bstnanec i zam\u011bstnavatel u\u0161et\u0159\u00ed na odvodech, co\u017e m\u016f\u017ee b\u00fdt finan\u010dn\u011b v\u00fdhodn\u00e9 pro ob\u011b strany.<\/span><\/p>\n<h4><b>3. V\u011bt\u0161\u00ed svoboda a \u010dasov\u00e1 flexibilita<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">DPP umo\u017e\u0148uje v\u011bt\u0161\u00ed svobodu a \u010dasovou flexibilitu. Zam\u011bstnanci mohou pracovat podle sv\u00fdch mo\u017enost\u00ed a pot\u0159eb, co\u017e je ide\u00e1ln\u00ed nap\u0159\u00edklad pro studenty, maminky na mate\u0159sk\u00e9 dovolen\u00e9 nebo d\u016fchodce. Tato <strong>flexibilita umo\u017e\u0148uje l\u00e9pe sladit pracovn\u00ed a osobn\u00ed nebo studijn\u00ed \u017eivot.<\/strong><\/span><\/p>\n<h4><b>4. Mo\u017enost p\u0159iv\u00fdd\u011blku<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">DPP je skv\u011blou mo\u017enost\u00ed pro ty, kte\u0159\u00ed si cht\u011bj\u00ed p\u0159ivyd\u011blat k hlavn\u00edmu zam\u011bstn\u00e1n\u00ed nebo studiu. D\u00edky n\u00edzk\u00fdm odvod\u016fm a jednoduch\u00e9 administrativ\u011b je ide\u00e1ln\u00ed pro kr\u00e1tkodob\u00e9 a jednor\u00e1zov\u00e9 pr\u00e1ce.<\/span><\/p>\n<h4><strong>5. N\u00e1rok na dovolenou<\/strong><\/h4>\n<p><span style=\"font-weight: 400;\">Pokud jde o dovolenou, zam\u011bstnanci pracuj\u00edc\u00ed na DPP maj\u00ed n\u00e1rok i na dovolenou. Zam\u011bstnavatel\u00e9 mus\u00ed tak\u00e9 nad\u00e1le registrovat sv\u00e9 zam\u011bstnance na DPP u \u010cesk\u00e9 spr\u00e1vy soci\u00e1ln\u00edho zabezpe\u010den\u00ed (\u010cSSZ) a hl\u00e1sit jejich p\u0159\u00edjmy. N\u00e1rok bude m\u00edt zam\u011bstnanec, pokud jeho dohoda trvala <strong>alespo\u0148 4 t\u00fddny (28 kalend\u00e1\u0159n\u00edch dn\u00ed)<\/strong> v dan\u00e9m kalend\u00e1\u0159n\u00edm roce a z\u00e1rove\u0148 odpracoval <strong>minim\u00e1ln\u011b 80 hodin.<\/strong><\/span><\/p>\n<h4><b>6. Snadn\u00e9 ukon\u010den\u00ed dohody<\/b><\/h4>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Dohodou:<\/b><span style=\"font-weight: 400;\"> Ob\u011b strany, zam\u011bstnavatel i zam\u011bstnanec, mus\u00ed souhlasit s ukon\u010den\u00edm a stanovit datum ukon\u010den\u00ed spolupr\u00e1ce. Dohoda by m\u011bla b\u00fdt p\u00edsemn\u00e1, p\u0159i\u010dem\u017e jedna kopie z\u016fst\u00e1v\u00e1 zam\u011bstnanci a druh\u00e1 zam\u011bstnavateli. Dohoda m\u016f\u017ee obsahovat i d\u016fvod ukon\u010den\u00ed.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>V\u00fdpov\u011bd\u00ed:<\/b><span style=\"font-weight: 400;\"> Zam\u011bstnanec m\u016f\u017ee podat p\u00edsemnou v\u00fdpov\u011b\u010f zam\u011bstnavateli s v\u00fdpov\u011bdn\u00ed lh\u016ftou 15 dn\u016f, kter\u00e1 za\u010d\u00edn\u00e1 b\u011b\u017eet dnem pod\u00e1n\u00ed. B\u011bhem t\u00e9to doby mus\u00ed zam\u011bstnanec plnit sv\u00e9 pracovn\u00ed povinnosti podle smlouvy.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Okam\u017eit\u00fdm zru\u0161en\u00edm:<\/b><span style=\"font-weight: 400;\"> Zam\u011bstnavatel m\u016f\u017ee okam\u017eit\u011b zru\u0161it dohodu, pokud zam\u011bstnanec hrub\u011b poru\u0161\u00ed sv\u00e9 pracovn\u00ed povinnosti. Zam\u011bstnanec m\u016f\u017ee dohodu okam\u017eit\u011b zru\u0161it nap\u0159\u00edklad ze zdravotn\u00edch d\u016fvod\u016f nebo pokud nedostane mzdu do 15 dn\u016f po splatnosti.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Zru\u0161en\u00edm ve zku\u0161ebn\u00ed dob\u011b: <\/b><span style=\"font-weight: 400;\">Pokud byla sjedn\u00e1na zku\u0161ebn\u00ed doba, m\u016f\u017ee b\u00fdt dohoda zru\u0161ena b\u011bhem t\u00e9to doby.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Uplynut\u00ed doby:<\/b><span style=\"font-weight: 400;\"> nej\u010dast\u011bji vy\u010derp\u00e1n\u00edm maxim\u00e1ln\u00edho ro\u010dn\u00edho hodinov\u00e9ho limitu.<\/span><\/li>\n<\/ol>\n<span class='mb-center maxbutton-8-center'><span class='maxbutton-8-container mb-container'><a class=\"maxbutton-8 maxbutton maxbutton-kurz-personalistiky\" target=\"_blank\" title=\"Kurz personalistiky\" rel=\"noopener\" href=\"https:\/\/orangeacademy.cz\/kurzy-personalistiky\"><span class='mb-text'>Studujte kurz personalistiky<\/span><\/a><\/span><\/span>\n<h2><span class=\"ez-toc-section\" id=\"Nevyhody_dohody_o_provedeni_prace\"><\/span><span style=\"font-weight: 400;\">Nev\u00fdhody dohody o proveden\u00ed pr\u00e1ce<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Nev\u00fdhodou DPP je, \u017ee pr\u00e1ce pro jednoho zam\u011bstnavatele v r\u00e1mci dohody o proveden\u00ed pr\u00e1ce nesm\u00ed v kalend\u00e1\u0159n\u00edm roce p\u0159es\u00e1hnout 300 hodin. Pokud uzav\u0159ete s jedn\u00edm zam\u011bstnavatelem v\u00edce dohod o proveden\u00ed pr\u00e1ce, <strong>celkov\u00fd po\u010det odpracovan\u00fdch hodin<\/strong> za v\u0161echny tyto dohody nesm\u00ed v dan\u00e9m roce p\u0159ekro\u010dit tento limit.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>P\u0159ekro\u010den\u00ed limitu 300 hodin u dohody o proveden\u00ed pr\u00e1ce (DPP) m\u016f\u017ee m\u00edt n\u011bkolik d\u016fsledk\u016f.<\/strong> Dohoda, kter\u00e1 p\u0159es\u00e1hne tento limit, se st\u00e1v\u00e1 neplatnou, co\u017e znamen\u00e1, \u017ee pr\u00e1ce vykonan\u00e1 nad r\u00e1mec 300 hodin je pova\u017eov\u00e1na za pr\u00e1ci bez platn\u00e9 smlouvy. Zam\u011bstnavatel m\u016f\u017ee \u010delit pokut\u011b a\u017e do v\u00fd\u0161e 300.000 K\u010d. Je tedy d\u016fle\u017eit\u00e9, aby zam\u011bstnavatel\u00e9 pe\u010dliv\u011b sledovali odpracovan\u00e9 hodiny, aby se vyhnuli t\u011bmto sankc\u00edm.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Jak_se_dani_DPP\"><\/span><span style=\"font-weight: 400;\">Jak se dan\u00ed DPP?<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Dan\u011bn\u00ed dohody o proveden\u00ed pr\u00e1ce z\u00e1vis\u00ed na v\u00fd\u0161i m\u011bs\u00ed\u010dn\u00edho p\u0159\u00edjmu a na tom, zda m\u00e1te podepsan\u00e9 prohl\u00e1\u0161en\u00ed k dani.<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>P\u0159\u00edjem do 11.499 K\u010d m\u011bs\u00ed\u010dn\u011b<\/b><span style=\"font-weight: 400;\">:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Pokud v\u00e1\u0161 m\u011bs\u00ed\u010dn\u00ed p\u0159\u00edjem nep\u0159es\u00e1hne 11.499 K\u010d, odv\u00e1d\u00ed se sr\u00e1\u017ekov\u00e1 da\u0148 ve v\u00fd\u0161i 15 %. Tato da\u0148 je kone\u010dn\u00e1 a nemus\u00edte ji uv\u00e1d\u011bt v da\u0148ov\u00e9m p\u0159izn\u00e1n\u00ed, pokud nechcete \u017e\u00e1dat o jej\u00ed vr\u00e1cen\u00ed.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>P\u0159\u00edjem nad 11.499 K\u010d m\u011bs\u00ed\u010dn\u011b<\/b><span style=\"font-weight: 400;\">:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Pokud v\u00e1\u0161 m\u011bs\u00ed\u010dn\u00ed p\u0159\u00edjem p\u0159es\u00e1hne 11.499 K\u010d, odv\u00e1d\u00ed se z\u00e1lohov\u00e1 da\u0148 ve v\u00fd\u0161i 15 %.
