V\u00fdsledky po\u010dt\u016f zalo\u017een\u00fdch \u017eivnost\u00ed a firem za prvn\u00ed \u010dtvrtlet\u00ed roku 2021 nav\u00edc nazna\u010duj\u00ed, \u017ee z\u00e1jem o podnikatelskou \u010dinnost v \u010cesku stoup\u00e1 a ekonomika se probouz\u00ed po n\u011bkolika nep\u0159\u00edzniv\u00fdch m\u011bs\u00edc\u00edch lo\u0148sk\u00e9ho roku.<\/p>\n<p>P\u0159esto faktem z\u016fst\u00e1v\u00e1, \u017ee po\u010det zam\u011bstnanc\u016f v\u00fdrazn\u011b p\u0159eva\u017euje po\u010det podnikatel\u016f, jak si m\u016f\u017eeme snadno spo\u010d\u00edtat. Ka\u017ed\u00fd z pracovn\u00edch model\u016f m\u00e1 sv\u00e1 pro a proti a jednodu\u0161e <strong>ka\u017ed\u00e9mu nevyhovuje to stejn\u00e9<\/strong>. Pro\u010d v\u0161ak o tolik p\u0159eva\u017euje po\u010det zam\u011bstnanc\u016f? Znamen\u00e1 to, \u017ee je zam\u011bstn\u00e1n\u00ed v\u00fdhodn\u011bj\u0161\u00ed nebo se do podnik\u00e1n\u00ed nehrne tolik lid\u00ed z jin\u00e9ho d\u016fvodu? Posu\u010fte sami.<\/p>\n<h3>Zam\u011bstn\u00e1n\u00ed: Definice<\/h3>\n<p>Zam\u011bstnaneck\u00fd pom\u011br je typicky uzav\u00edr\u00e1n na z\u00e1klad\u011b <strong>pracovn\u00ed smlouvy<\/strong> bu\u010f na neur\u010ditou dobu, nebo s jasn\u011b stanoven\u00fdm datem, dokdy smlouva plat\u00ed. D\u00e1le pak m\u016f\u017ee b\u00fdt prodlou\u017eena. Jedn\u00e1 se o pr\u00e1vn\u00ed vztah mezi zam\u011bstnancem a zam\u011bstnavatelem, ze kter\u00e9ho plynou pr\u00e1va i povinnosti pro ob\u011b strany. S podnikatelskou \u010dinnost\u00ed je to trochu slo\u017eit\u011bj\u0161\u00ed.<\/p>\n<h3>Podnikatelsk\u00e1 \u010dinnost nab\u00edz\u00ed dv\u011b mo\u017enosti<\/h3>\n<p>Podnikatelem se m\u016f\u017eete st\u00e1t dv\u011bma zp\u016fsoby. Pro men\u0161\u00ed a\u017e st\u0159edn\u00ed podnikatelsk\u00e9 z\u00e1m\u011bry se hod\u00ed jednodu\u0161\u0161\u00ed cesta, kterou je <a href=\"https:\/\/orangeacademy.cz\/clanky\/jak-zalozit-zivnostensky-list\/\" target=\"_blank\" rel=\"noopener\">zalo\u017een\u00ed \u017eivnostensk\u00e9ho opr\u00e1vn\u011bn\u00ed<\/a>. D\u00edky n\u011bmu se stanete tzv. OSV\u010c (osobou samostatn\u011b v\u00fdd\u011ble\u010dn\u011b \u010dinnou) bu\u010f na hlavn\u00ed, nebo vedlej\u0161\u00ed \u010dinnost.<\/p>\n<p>D\u00e1le m\u016f\u017eete zalo\u017eit vlastn\u00ed firmu\/<a href=\"https:\/\/orangeacademy.cz\/clanky\/spolecnost-s-rucenim-omezenym\/\" target=\"_blank\" rel=\"noopener\">spole\u010dnost s ru\u010den\u00edm omezen\u00fdm<\/a> (s. r. o.), kter\u00e1 se vyplat\u00ed p\u0159edev\u0161\u00edm v p\u0159\u00edpad\u011b v\u011bt\u0161\u00edch podnikatelsk\u00fdch z\u00e1m\u011br\u016f, nap\u0159\u00edklad kdy\u017e chcete zam\u011bstn\u00e1vat dal\u0161\u00ed lidi a podobn\u011b. Tento postup je sice byrokraticky i finan\u010dn\u011b n\u00e1ro\u010dn\u011bj\u0161\u00ed, av\u0161ak umo\u017e\u0148uje v\u00edce mo\u017enost\u00ed.<\/p>\n<p>Ob\u011b varianty (jak zam\u011bstn\u00e1n\u00ed, tak podnik\u00e1n\u00ed) jsou o\u0161et\u0159eny z\u00e1konem a lze je vykon\u00e1vat pouze za ur\u010dit\u00fdch podm\u00ednek.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Vyhody_a_nevyhody_zamestnani\"><\/span>V\u00fdhody a nev\u00fdhody zam\u011bstn\u00e1n\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Za\u010dneme tedy srovn\u00e1n\u00edm v\u0161ech v\u00fdhod a nev\u00fdhody \u010dast\u011bj\u0161\u00edho pracovn\u00edho modelu, kter\u00fdm je zam\u011bstn\u00e1n\u00ed. Jak\u00e9 existuj\u00ed pro a proti zam\u011bstnaneck\u00e9ho pom\u011bru a pro koho je tento zp\u016fsob pr\u00e1ce vhodn\u00fd?<\/p>\n<h3>1\/ Jistota pravideln\u00e9ho platu a pracovn\u00edho m\u00edsta<\/h3>\n<p>Pokud zrovna v\u00e1\u0161 zam\u011bstnavatel neproch\u00e1z\u00ed kriz\u00ed nebo nepad\u00e1 ekonomika, m\u00e1te prakticky jistotu, \u017ee za svou pr\u00e1ci dostanete sjednanou mzdu \u010di plat, a to ka\u017ed\u00fd m\u011bs\u00edc ve stejnou dobu a ve stejn\u00e9 v\u00fd\u0161i. Samoz\u0159ejm\u011b je vhodn\u00e9 m\u00edt v\u0161e \u0159e\u0161en\u00e9 ve smlouv\u011b, abyste se nesp\u00e1lili. U seri\u00f3zn\u00edho zam\u011bstnavatele se v\u0161ak nemus\u00edte b\u00e1t, \u017ee byste o sv\u00e9 vyd\u011blan\u00e9 pen\u00edze p\u0159i\u0161li.<\/p>\n<h3>2\/ Pravideln\u00e1 pracovn\u00ed doba<\/h3>\n<p>Pro n\u011bkoho v\u00fdhoda, pro jin\u00e9ho nikoliv. Obvykle v\u0161ak do zam\u011bstn\u00e1n\u00ed doch\u00e1z\u00edte v pravidelnou pracovn\u00ed dobu a po odpracovan\u00fdch hodin\u00e1ch odch\u00e1z\u00edte dom\u016f. Nej\u010dast\u011bji se jedn\u00e1 o jednosm\u011bnn\u00fd rann\u00ed, dvousm\u011bnn\u00fd (rann\u00ed a odpoledn\u00ed) nebo t\u0159\u00edsm\u011bnn\u00fd provoz firmy. V\u017edy byste tedy m\u011bli v\u011bd\u011bt dostate\u010dn\u011b dop\u0159edu, kdy se v\u00e1s pracovn\u00ed doba t\u00fdk\u00e1 a kdy m\u016f\u017eete &#8220;vypnout&#8221; a nic ne\u0159e\u0161it.<\/p>\n<h3>3\/ Nemocensk\u00e1 dovolen\u00e1<\/h3>\n<p>Ka\u017ed\u00e9mu se jednou za \u010das stane, \u017ee onemocn\u00ed nebo dojde k n\u011bjak\u00e9mu \u00farazu. V zam\u011bstn\u00e1n\u00ed v\u00e1s takov\u00e1 ud\u00e1lost nemus\u00ed p\u0159\u00edli\u0161 tr\u00e1pit. Nap\u0159\u00edklad n\u011bkolik dn\u00ed dovolen\u00e9 nav\u00edc, sick days, home office nebo pobyty ve wellness centrech ocen\u00ed asi ka\u017ed\u00fd.<\/p>\n<h3>5\/ Dovolen\u00e1 bez v\u00fd\u010ditek<\/h3>\n<p>V zam\u011bstn\u00e1n\u00ed v\u00e1s dle smlouvy \u010dek\u00e1 jasn\u011b dan\u00fd po\u010det dn\u00ed dovolen\u00e9, kter\u00e9 si m\u016f\u017eete vybrat podle sv\u00fdch p\u0159edstav. V tu chv\u00edli v\u00e1s nemus\u00ed nic tr\u00e1pit, m\u016f\u017eete vypnout firemn\u00ed telefon a starosti hodit za hlavu. Samoz\u0159ejm\u011b <strong>z\u00e1le\u017e\u00ed na oboru podnik\u00e1n\u00ed<\/strong> a tak\u00e9 na tom, co v\u00e1m objem pr\u00e1ce dovol\u00ed, ale v podnik\u00e1n\u00ed v\u00e1s jednodu\u0161e \u010dek\u00e1 v\u011bt\u0161\u00ed svoboda, flexibiln\u011bj\u0161\u00ed pracovn\u00ed doba a nikdo v\u00e1m neur\u010duje, zda budete m\u00edt 25 dn\u00ed dovolen\u00e9 za rok nebo t\u0159eba 35.<\/p>\n<h3>3\/ Rozhodujete vy<\/h3>\n<p>S v\u00fd\u0161e uveden\u00fdm bodem tak\u00e9 souvis\u00ed to, \u017ee vy jste sami sob\u011b \u0161\u00e9fem.
