style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Pracovn\u00ed pom\u011br vznik\u00e1 dnem, kter\u00fd je sjedn\u00e1n v pracovn\u00ed smlouv\u011b jako den n\u00e1stupu do pr\u00e1ce.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Smlouva mus\u00ed b\u00fdt p\u00edsemn\u00e1 a mus\u00ed obsahovat:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">druh pr\u00e1ce, kterou bude zam\u011bstnanec vykon\u00e1vat,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">m\u00edsto v\u00fdkonu pr\u00e1ce,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">den n\u00e1stupu do pr\u00e1ce.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Ka\u017ed\u00e1 strana (zam\u011bstnanec i zam\u011bstnavatel) mus\u00ed obdr\u017eet jedno vyhotoven\u00ed smlouvy.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3>Jmenov\u00e1n\u00edm<\/h3>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li aria-level=\"2\"><span style=\"font-weight: 400;\">Pracovn\u00ed pom\u011br vznik\u00e1 jmenov\u00e1n\u00edm do funkce.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Tento zp\u016fsob se uplat\u0148uje zejm\u00e9na u vedouc\u00edch pracovn\u00edk\u016f ve:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">st\u00e1tn\u00ed spr\u00e1v\u011b,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">p\u0159\u00edsp\u011bvkov\u00fdch organizac\u00edch,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">Policii \u010cR.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3>Volbou<\/h3>\n<ul>\n<li><span style=\"font-weight: 400;\">Pou\u017e\u00edv\u00e1 se, pokud to vy\u017eaduje zvl\u00e1\u0161tn\u00ed pr\u00e1vn\u00ed p\u0159edpis nebo stanovy (nap\u0159. u odborov\u00fdch organizac\u00ed).<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Pracovn\u00ed pom\u011br vznik\u00e1 na z\u00e1klad\u011b volby p\u0159\u00edslu\u0161n\u00fdm org\u00e1nem.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Volba je p\u0159edpokladem pro uzav\u0159en\u00ed pracovn\u00ed smlouvy.<\/span><\/li>\n<\/ul>\n<\/div>\n<h2><span class=\"ez-toc-section\" id=\"Druhy_pracovniho_pomeru_ktere_muzete_uzavrit\"><\/span><span style=\"font-weight: 400;\">Druhy pracovn\u00edho pom\u011bru, kter\u00e9 m\u016f\u017eete uzav\u0159\u00edt<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">Hlavn\u00ed pracovn\u00ed pom\u011br (HPP)<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Zam\u011bstnanci p\u0159ijat\u00ed na hlavn\u00ed pracovn\u00ed pom\u011br tvo\u0159\u00ed stabiln\u00ed z\u00e1klad ka\u017ed\u00e9 firmy. Tento typ smlouvy je ide\u00e1ln\u00ed pro dlouhodobou spolupr\u00e1ci s pravidelnou pracovn\u00ed dobou.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pln\u00fd \u00favazek: obvykle 40 hodin t\u00fddn\u011b<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Po\u010det odpracovan\u00fdch hodin za m\u011bs\u00edc: cca 160\u2013176 hodin<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Zku\u0161ebn\u00ed doba: a\u017e 4 m\u011bs\u00edce (u vedouc\u00edch pozic a\u017e 8 m\u011bs\u00edc\u016f)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">V\u00fdpov\u011bdn\u00ed lh\u016fta: za\u010d\u00edn\u00e1 b\u011b\u017eet dnem doru\u010den\u00ed v\u00fdpov\u011bdi<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Smlouva: na dobu ur\u010ditou (max. 3 roky, 2 prodlou\u017een\u00ed) nebo neur\u010ditou<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">V\u00fdjimka: z\u00e1stup za rodi\u010dovskou dovolenou \u2013 a\u017e 9 let<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Zam\u011bstnanci na HPP se zapojuj\u00ed do firemn\u00edch proces\u016f, z\u00edsk\u00e1vaj\u00ed know-how a p\u0159in\u00e1\u0161ej\u00ed firm\u011b dlouhodobou hodnotu. Na druhou stranu jsou s nimi spojeny vy\u0161\u0161\u00ed n\u00e1klady \u2013 zejm\u00e9na na odvody a fixn\u00ed mzdu.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Lze_mit_dve_zamestnani_na_hlavni_pracovni_pomer\"><\/span><span style=\"font-weight: 400;\">Lze m\u00edt dv\u011b zam\u011bstn\u00e1n\u00ed na hlavn\u00ed pracovn\u00ed pom\u011br?<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Dv\u011b zam\u011bstn\u00e1n\u00ed na hlavn\u00ed pracovn\u00ed pom\u011br jsou leg\u00e1ln\u00ed a mo\u017en\u00e9.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Co \u0159\u00edk\u00e1 z\u00e1kon\u00edk pr\u00e1ce?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Z\u00e1kon\u00edk pr\u00e1ce nezakazuje m\u00edt v\u00edce pracovn\u00edch pom\u011br\u016f sou\u010dasn\u011b, a to ani na pln\u00fd \u00favazek. Ka\u017ed\u00fd pracovn\u00ed pom\u011br je samostatn\u00fd a mus\u00ed b\u00fdt uzav\u0159en p\u00edsemn\u011b. Z\u00e1kon dnes u\u017e nerozli\u0161uje mezi \u201ehlavn\u00edm\u201c a \u201evedlej\u0161\u00edm\u201c pracovn\u00edm pom\u011brem \u2013 jde pouze o pracovn\u00ed pom\u011br jako takov\u00fd.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Na co si d\u00e1t pozor?<\/span><\/h3>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Konkuren\u010dn\u00ed dolo\u017eka:<\/strong> Pokud je v pracovn\u00ed smlouv\u011b uvedena, m\u016f\u017ee v\u00e1m zak\u00e1zat pracovat pro jin\u00e9ho zam\u011bstnavatele ve stejn\u00e9m nebo podobn\u00e9m oboru. V takov\u00e9m p\u0159\u00edpad\u011b je nutn\u00fd p\u00edsemn\u00fd souhlas zam\u011bstnavatele.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Zdravotn\u00ed a soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed:<\/strong> Odvody se plat\u00ed z obou pracovn\u00edch pom\u011br\u016f. Ka\u017ed\u00fd zam\u011bstnavatel je povinen p\u0159ihl\u00e1sit v\u00e1s k poji\u0161t\u011bn\u00ed zvl\u00e1\u0161\u0165.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Dan\u011b:<\/strong> Da\u0148ov\u00e9 slevy (nap\u0159. na poplatn\u00edka) m\u016f\u017eete uplatnit pouze u jednoho zam\u011bstnavatele. Pokud m\u00e1te dv\u011b zam\u011bstn\u00e1n\u00ed, mus\u00edte si da\u0148ov\u00e9 p\u0159izn\u00e1n\u00ed zpracovat sami, pokud v\u00e1m ho nezpracov\u00e1v\u00e1 hlavn\u00ed zam\u011bstnavatel.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Nemocensk\u00e1:<\/strong> V p\u0159\u00edpad\u011b nemoci v\u00e1m l\u00e9ka\u0159 vystav\u00ed dv\u011b neschopenky \u2013 pro ka\u017ed\u00e9ho zam\u011bstnavatele zvl\u00e1\u0161\u0165. N\u00e1hradu mzdy dost\u00e1v\u00e1te od obou, podle odpracovan\u00fdch hodin.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Z praktick\u00e9ho hlediska ale m\u016f\u017ee b\u00fdt kombinace dvou hlavn\u00edch pracovn\u00edch pom\u011br\u016f velmi n\u00e1ro\u010dn\u00e1 \u2013 jak z hlediska organizace \u010dasu, tak i fyzick\u00e9 a psychick\u00e9 z\u00e1t\u011b\u017ee. Tento typ \u00favazku je vhodn\u00fd pro rodi\u010de, seniory nebo osoby pe\u010duj\u00edc\u00ed o bl\u00edzk\u00e9.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Vedlej\u0161\u00ed pracovn\u00ed pom\u011br<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Vedlej\u0161\u00ed pracovn\u00ed pom\u011br je druh\u00fd pracovn\u00ed pom\u011br vedle hlavn\u00edho zam\u011bstn\u00e1n\u00ed. M\u016f\u017ee b\u00fdt sjedn\u00e1n jako <strong>zkr\u00e1cen\u00fd \u00favazek nebo formou dohod.<\/strong> Je d\u016fle\u017eit\u00e9, aby nedoch\u00e1zelo ke st\u0159etu z\u00e1jm\u016f. \u010cesk\u00e1 legislativa umo\u017e\u0148uje, aby jedna osoba m\u011bla uzav\u0159en\u00e9 dva pracovn\u00ed pom\u011bry na pln\u00fd \u00favazek z\u00e1rove\u0148. Je v\u0161ak d\u016fle\u017eit\u00e9, aby s t\u00edm souhlasili oba zam\u011bstnavatel\u00e9 \u2013 zejm\u00e9na pokud se jedn\u00e1 o podobn\u00e9 pracovn\u00ed oblasti. V n\u011bkter\u00fdch p\u0159\u00edpadech m\u016f\u017ee b\u00fdt ve smlouv\u011b uvedena tzv. konkuren\u010dn\u00ed dolo\u017eka, kter\u00e1 zam\u011bstnanci zakazuje pracovat pro jinou firmu ve stejn\u00e9m nebo podobn\u00e9m oboru.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Dohoda o proveden\u00ed pr\u00e1ce (DPP)<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Dohoda o proveden\u00ed pr\u00e1ce (DPP) je vhodn\u00e1 forma pracovn\u00edho vztahu zejm\u00e9na pro kr\u00e1tkodob\u00e9 nebo jednor\u00e1zov\u00e9 \u010dinnosti, nap\u0159\u00edklad sez\u00f3nn\u00ed v\u00fdpomoc, administrativn\u00ed pr\u00e1ce nebo jin\u00e9 \u00fakoly s omezen\u00fdm rozsahem. V takov\u00e9m p\u0159\u00edpad\u011b nevznik\u00e1 pracovn\u00ed pom\u011br, a tedy ani povinnost odv\u00e1d\u011bt za n\u011b soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed, poskytovat jim dovolenou nebo dodr\u017eovat v\u00fdpov\u011bdn\u00ed lh\u016fty. Spolupr\u00e1ce se \u0159\u00edd\u00ed obchodn\u00ed smlouvou, nej\u010dast\u011bji smlouvou o d\u00edlo, p\u0159\u00edpadn\u011b jin\u00fdm typem smluvn\u00edho ujedn\u00e1n\u00ed podle ob\u010dansk\u00e9ho z\u00e1kon\u00edku.
