Dohoda o pracovn\u00ed \u010dinnosti (DP\u010c) je specifick\u00fd pracovn\u011bpr\u00e1vn\u00ed vztah mezi zam\u011bstnancem a zam\u011bstnavatelem, kter\u00fd <strong>umo\u017e\u0148uje pracovat maxim\u00e1ln\u011b 20 hodin t\u00fddn\u011b u jednoho zam\u011bstnavatele.<\/strong> Tento limit plat\u00ed pro ka\u017ed\u00e9ho zam\u011bstnavatele zvl\u00e1\u0161\u0165, tak\u017ee je mo\u017en\u00e9 m\u00edt v\u00edce DP\u010c u r\u016fzn\u00fdch zam\u011bstnavatel\u016f.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Dohoda o pracovn\u00ed \u010dinnosti: Soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">U dohody o pracovn\u00ed \u010dinnosti se zdravotn\u00ed a soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed odv\u00e1d\u00ed, pokud m\u011bs\u00ed\u010dn\u00ed p\u0159\u00edjem p\u0159es\u00e1hne 4.000 K\u010d. Kdo plat\u00ed zdravotn\u00ed poji\u0161t\u011bn\u00ed? Zam\u011bstnanec hrad\u00ed 4,5 % z hrub\u00e9 mzdy a zam\u011bstnavatel 9 % na zdravotn\u00ed poji\u0161t\u011bn\u00ed. 6,5 % z hrub\u00e9 mzdy hrad\u00ed zam\u011bstnanec a zam\u011bstnavatel 24,8 % na soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Dohoda o pracovn\u00ed \u010dinnosti: Odvody na dan\u011b<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">DP\u010c dan\u011b se odv\u00e1d\u011bj\u00ed podobn\u011b jako u b\u011b\u017en\u00e9ho pracovn\u00edho pom\u011bru. Z hrub\u00e9 mzdy se <strong>odv\u00e1d\u00ed 15% da\u0148 z p\u0159\u00edjmu.<\/strong> Pokud m\u00e1te podepsan\u00e9 prohl\u00e1\u0161en\u00ed k dani, m\u016f\u017eete uplatnit slevy na dani, co\u017e sn\u00ed\u017e\u00ed v\u00fdslednou da\u0148ovou povinnost.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Kl\u00ed\u010dov\u00e9 body DP\u010c:<\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Omezen\u00ed hodin<\/b><span style=\"font-weight: 400;\">: Maxim\u00e1ln\u011b 20 hodin t\u00fddn\u011b u jednoho zam\u011bstnavatele.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Dovolen\u00e1<\/b><span style=\"font-weight: 400;\">: Po novele z\u00e1kon\u00edku pr\u00e1ce maj\u00ed zam\u011bstnanci na DP\u010c n\u00e1rok na dovolenou a p\u0159\u00edplatky za pr\u00e1ci o sv\u00e1tc\u00edch. Dovolenou lze \u010derpat po \u010dty\u0159ech t\u00fddnech a odpracov\u00e1n\u00ed alespo\u0148 80 hodin.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>V\u00fdpov\u011b\u010f<\/b><span style=\"font-weight: 400;\">: Dohodu lze vypov\u011bd\u011bt kdykoli bez ud\u00e1n\u00ed d\u016fvodu s v\u00fdpov\u011bdn\u00ed lh\u016ftou 15 dn\u00ed.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Minim\u00e1ln\u00ed mzda<\/b><span style=\"font-weight: 400;\">: Hodinov\u00e1 odm\u011bna nesm\u00ed b\u00fdt ni\u017e\u0161\u00ed ne\u017e minim\u00e1ln\u00ed mzda.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed<\/b><span style=\"font-weight: 400;\">: Pokud m\u011bs\u00ed\u010dn\u00ed p\u0159\u00edjem p\u0159es\u00e1hne ur\u010ditou hranici, odv\u00e1d\u00ed se z n\u011bj soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">DP\u010c je vhodn\u00e1 pro pravidelnou, ale \u010d\u00e1ste\u010dnou pr\u00e1ci, nap\u0159\u00edklad brig\u00e1dy nebo vedlej\u0161\u00ed pracovn\u00ed \u010dinnosti.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Co_je_dohoda_o_provedeni_prace\"><\/span><span style=\"font-weight: 400;\">Co je dohoda o proveden\u00ed pr\u00e1ce ?<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">DPP mus\u00ed b\u00fdt uzav\u0159ena p\u00edsemn\u011b. Dohoda by m\u011bla obsahovat:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Identifikaci <a href=\"https:\/\/orangeacademy.cz\/clanky\/pracovni-smlouva-vzor-ke-stazeni\/\" target=\"_blank\" rel=\"noopener\">smluvn\u00edch stran<\/a>:<\/b><span style=\"font-weight: 400;\"> Va\u0161e jm\u00e9no a n\u00e1zev zam\u011bstnavatele.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Popis pr\u00e1ce:<\/b><span style=\"font-weight: 400;\"> Podrobn\u00fd popis pr\u00e1ce, kterou budete vykon\u00e1vat<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Rozsah pr\u00e1ce:<\/b><span style=\"font-weight: 400;\"> Maxim\u00e1ln\u011b 300 hodin ro\u010dn\u011b.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Odm\u011bnu za pr\u00e1ci: <\/b>O<span style=\"font-weight: 400;\">dm\u011bna za hodinu, za projekt, nebo za m\u011bs\u00edc.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Podpis dohody<\/b><span style=\"font-weight: 400;\">: Ob\u011b strany mus\u00ed dohodu podepsat.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Evidence odpracovan\u00fdch hodin<\/b><span style=\"font-weight: 400;\">: Veden\u00ed evidence odpracovan\u00fdch hodin je d\u016fle\u017eit\u00e9, abyste nep\u0159ekro\u010dili limit 300 hodin ro\u010dn\u011b.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>V\u00fdplata odm\u011bny<\/b><span style=\"font-weight: 400;\">: Po dokon\u010den\u00ed pr\u00e1ce a p\u0159edlo\u017een\u00ed v\u00fdsledk\u016f klientovi by m\u011bla b\u00fdt vyplacena dohodnut\u00e1 odm\u011bna.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Da\u0148ov\u00e9 povinnosti<\/b><span style=\"font-weight: 400;\">: Pokud v\u00e1\u0161 m\u011bs\u00ed\u010dn\u00ed p\u0159\u00edjem z DPP nep\u0159es\u00e1hne 10.000 K\u010d, neplat\u00edte soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed. Nicm\u00e9n\u011b, p\u0159\u00edjem z DPP je zdaniteln\u00fd a m\u011bli byste jej uv\u00e9st ve sv\u00e9m da\u0148ov\u00e9m p\u0159izn\u00e1n\u00ed.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Doba trv\u00e1n\u00ed<\/b><span style=\"font-weight: 400;\">: Vhodn\u00e1 pro jednor\u00e1zov\u00e9 nebo kr\u00e1tkodob\u00e9 pr\u00e1ce.<\/span><\/li>\n<\/ul>\n<p><b>P\u0159\u00edklad<\/b><span style=\"font-weight: 400;\">: P\u0159edstavte si, \u017ee jste grafik a dostanete nab\u00eddku vytvo\u0159it logo pro malou firmu. Tento projekt je jednor\u00e1zov\u00fd a o\u010dek\u00e1v\u00e1 se, \u017ee pr\u00e1ce zabere p\u0159ibli\u017en\u011b 50 hodin. V tomto p\u0159\u00edpad\u011b by DPP byla vhodn\u00e1, proto\u017ee:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Jednor\u00e1zov\u00fd projekt<\/b><span style=\"font-weight: 400;\">: Pr\u00e1ce na logu je jednor\u00e1zov\u00fd \u00fakol, kter\u00e1 nebude pokra\u010dovat po dokon\u010den\u00ed.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>\u010casov\u00fd rozsah<\/b><span style=\"font-weight: 400;\">: Projekt nep\u0159es\u00e1hne 300 hodin ro\u010dn\u011b.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Finan\u010dn\u00ed limit<\/b><span style=\"font-weight: 400;\">: Pokud v\u00e1\u0161 m\u011bs\u00ed\u010dn\u00ed p\u0159\u00edjem z tohoto projektu nep\u0159es\u00e1hne 10.000 K\u010d, nebudete muset odv\u00e1d\u011bt soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Tento typ dohody je tedy ide\u00e1ln\u00ed pro kr\u00e1tkodob\u00e9 a jednor\u00e1zov\u00e9 projekty, kde nen\u00ed pot\u0159eba dlouhodob\u00fd pracovn\u00ed vztah.<\/span><\/p>\n<div id=\"attachment_9872\" style=\"width: 940px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-9872\" class=\"wp-image-9872 size-large\" src=\"https:\/\/orangeacademy.cz\/clanky\/wp-content\/uploads\/2019\/12\/DPC-930x620.jpeg\" alt=\"DP\u010c\" width=\"930\" height=\"620\" \/><p id=\"caption-attachment-9872\" class=\"wp-caption-text\">DP\u010c je vhodn\u00e1 pro pravidelnou, ale \u010d\u00e1ste\u010dnou pr\u00e1ci, nap\u0159\u00edklad brig\u00e1dy nebo vedlej\u0161\u00ed pracovn\u00ed \u010dinnosti.<\/p><\/div>\n<h2><span class=\"ez-toc-section\" id=\"Kdy_uzavrit_DPC_nebo_DPP\"><\/span><span style=\"font-weight: 400;\">Kdy uzav\u0159\u00edt DP\u010c nebo DPP?<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Pokud jde o kr\u00e1tkodobou pr\u00e1ci, j<strong>e vhodn\u011bj\u0161\u00ed dohoda o proveden\u00ed pr\u00e1ce (DPP).<\/strong> Tato dohoda m\u00e1 vy\u0161\u0161\u00ed m\u011bs\u00ed\u010dn\u00ed p\u0159\u00edjmov\u00fd limit, do kter\u00e9ho se neplat\u00ed soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed, co\u017e ji \u010din\u00ed ide\u00e1ln\u00ed pro letn\u00ed brig\u00e1dy a podobn\u00e9 kr\u00e1tkodob\u00e9 aktivity. Naopak pro dlouhodob\u011bj\u0161\u00ed spolupr\u00e1ci na \u010d\u00e1ste\u010dn\u00fd \u00favazek je lep\u0161\u00ed dohoda o pracovn\u00ed \u010dinnosti (DP\u010c).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dohoda o pracovn\u00ed \u010dinnosti (DP\u010c) umo\u017e\u0148uje maxim\u00e1ln\u00ed pracovn\u00ed dobu 20 hodin t\u00fddn\u011b, co\u017e odpov\u00edd\u00e1 <a href=\"https:\/\/orangeacademy.cz\/clanky\/pracovni-doba-v-cr\/\" target=\"_blank\" rel=\"noopener\">polovin\u011b b\u011b\u017en\u00e9 pracovn\u00ed doby<\/a>, tedy p\u0159ibli\u017en\u011b 1.000 hodin ro\u010dn\u011b. Na druhou stranu, dohoda o proveden\u00ed pr\u00e1ce (DPP) m\u00e1 ro\u010dn\u00ed limit 300 hodin, co\u017e znamen\u00e1, \u017ee kr\u00e1tkodob\u011b m\u016f\u017eete odpracovat v\u00edce hodin najednou ne\u017e na DP\u010c, ale ne dlouhodob\u011b.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sr\u00e1\u017ekov\u00e1 da\u0148 je da\u0148, kter\u00e1 se nej\u010dast\u011bji uplat\u0148uje na men\u0161\u00ed p\u0159\u00edjmy z dohod o proveden\u00ed pr\u00e1ce nebo dohod o pracovn\u00ed \u010dinnosti. Jej\u00ed sazba je 15 % a odv\u00e1d\u00ed ji ten, kdo vypl\u00e1c\u00ed odm\u011bnu. <strong>P\u0159\u00edjemce odm\u011bny tedy dost\u00e1v\u00e1 ji\u017e zdan\u011bn\u00e9 pen\u00edze.<\/strong><\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Z_pohledu_zamestnavatele\"><\/span><span style=\"font-weight: 400;\">Z pohledu zam\u011bstnavatele<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><b>DP\u010c<\/b><span style=\"font-weight: 400;\">: Pokud <a href=\"https:\/\/orangeacademy.cz\/clanky\/dpp-z-pohledu-zamestnavatele\/\" target=\"_blank\" rel=\"noopener\">pot\u0159ebujete pravidelnou, ale \u010d\u00e1ste\u010dnou pracovn\u00ed s\u00edlu,<\/a> nap\u0159\u00edklad pro dlouhodob\u011bj\u0161\u00ed brig\u00e1dy nebo vedlej\u0161\u00ed pracovn\u00ed \u010dinnosti.<\/span><\/p>\n<p><b>DPP<\/b><span style=\"font-weight: 400;\">: Pokud pot\u0159ebujete pracovn\u00edka na jednor\u00e1zov\u00fd projekt nebo kr\u00e1tkodob\u00fd \u00fakol, kter\u00fd nep\u0159es\u00e1hne 300 hodin ro\u010dn\u011b.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"DPP_a_DPC_u_jednoho_zamestnavatele\"><\/span><span style=\"font-weight: 400;\">DPP a DP\u010c u jednoho zam\u011bstnavatele<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">U jednoho zam\u011bstnavatele nelze pracovat na dohodu o proveden\u00ed pr\u00e1ce (DPP) a z\u00e1rove\u0148 na dohodu o pracovn\u00ed \u010dinnosti (DP\u010c) v r\u00e1mci jedn\u00e9 pozice nebo pracovn\u00ed n\u00e1pln\u011b. <strong>Po\u010det DPP ani DP\u010c u r\u016fzn\u00fdch zam\u011bstnavatel\u016f v\u0161ak nen\u00ed omezen, tak\u017ee zam\u011bstnanec m\u016f\u017ee m\u00edt nap\u0159\u00edklad t\u0159i dohody o proveden\u00ed pr\u00e1ce u r\u016fzn\u00fdch zam\u011bstnavatel\u016f.<\/strong> Pokud by v\u0161ak zam\u011bstnanec vykon\u00e1val vedle DPP dal\u0161\u00ed v\u00fdd\u011ble\u010dnou \u010dinnost, kter\u00e1 je shodn\u00e1 s p\u0159edm\u011btem \u010dinnosti zam\u011bstnavatele, m\u016f\u017ee tak u\u010dinit pouze s jeho p\u0159edchoz\u00edm souhlasem. Jinak riskuje poru\u0161en\u00ed sv\u00fdch povinnost\u00ed a ukon\u010den\u00ed DPP ze strany zam\u011bstnavatele.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Dohoda o pracovn\u00ed \u010dinnosti: Na co si d\u00e1t pozor?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Pokud brig\u00e1dn\u00edk pracuje pro jednoho zam\u011bstnavatele na v\u00edce dohod, ka\u017ed\u00e1 dohoda mus\u00ed m\u00edt jinou pracovn\u00ed n\u00e1pl\u0148.
